Service contract

With a service contract, one party undertakes to provide a service to the other contracting party. The service to be rendered provides the contracting party with a material or non-material benefit and takes many different forms in everyday life. For example, work, manufacturing, freight and other types of orders are to be classified as service contracts. Package tour contracts governed by special laws or passenger transport contracts are also to be classified as service contracts.

Other service contracts are not expressly governed by law, such as franchise agreements or support contracts, for example. In the case of such service contracts, the provisions of contract types stipulated by law (e.g. employment contract law, law of agency) can be applied mutatis mutandis for interpretation purposes.
